1. Acceptance of Terms

Welcome to EN Uhmegle (referred to as "we," "us," "our," or the "Platform"). These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and EN Uhmegle. These Terms govern your access to and use of the eng-uhmegle.com website, our random video chat services, text messaging tools, and any related applications or services provided by us (collectively, the "Services").

Please read these Terms carefully before utilizing our platform. By clicking "Start Chatting", accessing the website, or participating in any video or text communications on our network, you acknowledge that you have read, understood, and unreservedly agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you are expressly prohibited from accessing the Services and must discontinue your use immediately.

2. Eligibility and Age Restrictions

The Services provided by our cam site are strictly intended for an adult audience. You must be at least eighteen (18) years of age, or the age of legal majority in your specific jurisdiction of residence (whichever is greater), to access, view, or participate in the random video chat network. Use of this platform by anyone under the age of 18 is strictly prohibited.

By accessing the Platform, you represent and warrant that you meet this age requirement and possess the legal capacity to enter into a binding contract. We maintain a zero-tolerance policy regarding underage usage. If we discover, or have reasonable grounds to suspect, that a minor is using the service, we will immediately terminate the connection, permanently block the associated IP address and device fingerprint, and, where appropriate, report the incident to child safety organizations and law enforcement.

3. Description of the Services

EN Uhmegle operates as a global, randomized live cam and video chat router. We utilize advanced WebRTC (Web Real-Time Communication) technology to facilitate instantaneous, peer-to-peer (P2P) audiovisual and text communication between users around the world. The primary function of the Platform is to pair you randomly with another user ("Stranger") based on broad parameters such as location or shared interests.

Due to the live and unfiltered nature of peer-to-peer communications, we act solely as a neutral intermediary. We cannot guarantee continuous, uninterrupted, or perfectly secure access to the Services. Connection quality may fluctuate based on your internet speed, hardware capabilities, and geographical routing. Furthermore, because users generate all content in real-time, you acknowledge that you may encounter unpredictable behavior, and you use the random video chat functionality entirely at your own risk.

4. User Conduct and Acceptable Use Policy

As a user of our live cam network, you are entirely responsible for the content of your video broadcasts, audio transmissions, and text messages. We are committed to fostering a safe, respectful, and consensual environment. By utilizing the Platform, you explicitly agree NOT to engage in any of the following prohibited activities:

• Illegal Acts: Using the Services to coordinate, promote, or engage in any unlawful activities. This includes the distribution of illicit materials, trafficking, promoting terrorism, or soliciting minors.
• Harassment and Hate Speech: Broadcasting or typing content that is abusive, threatening, defamatory, harassing, or that promotes violence and hatred against individuals or groups based on race, ethnicity, religion, sexual orientation, gender identity, or disability.
• Non-Consensual Recording: Capturing, recording, screen-recording, or distributing the video or audio feeds of any other user on the platform without their explicit, prior, and verifiable consent. This violates global privacy laws and is strictly forbidden.
• Nudity and Explicit Content: Broadcasting explicit sexual acts, pornography, full or partial nudity, or exposing genitalia on camera in the public matching pool is not permitted. Users seeking explicit interactions must use alternative, dedicated adult platforms.
• Spam and Commercial Exploitation: Transmitting unauthorized advertisements, affiliate links, promotional materials, spam, or utilizing bots/scripts to artificially interact with the platform and its users.
• Platform Circumvention: Attempting to reverse-engineer our matchmaking algorithms, hack our servers, bypass our moderation tools, or evade an active IP ban using Virtual Private Networks (VPNs) or proxies.

Violation of this Acceptable Use Policy constitutes a material breach of these Terms. We reserve the absolute right to terminate your connection, ban your device, and permanently block your access to the Platform using automated AI and manual moderation tools.

5. User-Generated Content and Broadcasting Rights

When you activate your webcam and microphone on the uhmegle platform, you are generating real-time User-Generated Content ("UGC"). You retain all inherent ownership rights to your personal image and likeness. However, by initiating a broadcast, you grant us a worldwide, non-exclusive, royalty-free, and temporary license to route, transmit, display, and process your video and audio feeds solely for the purpose of operating the Services and connecting you with other users.

You represent and warrant that you possess all necessary rights and authority to broadcast the content you display. As an ephemeral random chat site, our system is designed to facilitate live connections. We do not actively record, archive, or permanently store your private 1-on-1 video streams on our database. However, to maintain platform integrity, automated AI moderation systems may temporarily process frames of your video feed to detect severe violations of our Terms. Text chat logs and moderation metadata may also be retained temporarily in accordance with our Privacy Policy.

6. Intellectual Property Rights

All proprietary content, features, and technical functionality of the Platform—including but not limited to the website design, logos, color schemes, text, graphics, user interface, software code, and proprietary matchmaking algorithms—are the exclusive property of EN Uhmegle and its licensors. These assets are protected by international copyright, trademark, patent, and trade secret laws.

You are granted a limited, personal, non-transferable, and revocable license to access and use the Platform strictly for its intended personal, non-commercial use. You may not copy, reproduce, distribute, modify, reverse-engineer, or create derivative works from any part of our intellectual property without our express, prior written consent.

7. Third-Party Links and Services

The Platform may contain links to third-party websites, advertisers, or services that are not owned, operated, or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party websites. If you click on a third-party link or engage with an external service, you do so entirely at your own risk. We strongly advise you to read the terms and privacy policies of any third-party site you visit. You expressly relieve us from any and all liability arising from your use of third-party websites or services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, PRIVACY, SECURITY, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS. BECAUSE WE ROUTE RANDOM CONNECTIONS IN REAL-TIME, WE DO NOT ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR THE BEHAVIOR, CONDUCT, OR CONTENT GENERATED BY ANY INDIVIDUAL USER YOU MAY ENCOUNTER ON THE PLATFORM.

9. Limitation of Liability

IN NO EVENT SHALL EN UHMEGLE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT, CONTENT, OR BROADCAST OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

10. Indemnification

You agree to defend, indemnify, and hold harmless EN Uhmegle, its parent companies, officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debts, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Services; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your User-Generated Content or live broadcast caused damage to a third party.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms, including the formation, interpretation, breach, or termination thereof, shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class-action lawsuit or class-wide arbitration against EN Uhmegle.

12. Modifications to the Terms

We reserve the right, at our sole discretion, to modify, amend, or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect (e.g., updating the "Effective Date" at the top of this page). What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Services immediately.
